Rexona V8 Hamilton 400 Promotion – Feb-March 2009

1.Entry instructions form part of these Terms and Conditions of entry. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.Entry is via text and is open to all New Zealand residents with a text capable mobile except employees and immediate families of companies involved in the promotion and their agencies.

3.Promotion commences 12:01am Monday 23rd February 2009 and ends 11:59pm Monday 23rd March 2009.

4.To enter this promotion entrants must: (a) purchase a specially marked Rexona Antiperspirant aerosol product and (b) text the unique code found on the Rexona promotional label to 8466. An auto-reply will be sent via text to confirm receipt of valid or invalid entries.

5.Each mobile phone owner can enter as many times as they want provided they purchase a separate specially marked Rexona product for each entry and provide the unique code found on the promotional label for each entry. Each unique code can only be entered into the promotion once. All text messages to 8466 will cost a maximum of $0.20 (including GST) each.

6.The owner of the mobile phone number, if drawn a winner, will be deemed the winner of the prize.

7.All entrants to the promotion will automatically go into the Major Prize draw, including winners of weekly prizes. Winning a weekly prize is not a prerequisite to be entered in the draw for the major prize. The 10 Major Prize winners will be drawn randomly by Spark Activate at noon 24th March 2009. The winners will be contacted and notified of their prize by telephone.

8.Each major prize (valued at up to $7,000 depending on point of departure) includes return economy airfares between winners residence in New Zealand and Auckland, for the winner and one friend; two (2) day passes to Hamilton 400 Street Race on 18th and 19th April 2009; two (2) nights twin share accommodation in the Quadrant Hotel Auckland, 10 Waterloo Quadrant, Auckland, in 17 April 2009 – out 19 April 2009 including breakfast and transfers to and from racetrack; hospitality in a premium Trackside Villa corporate suite; merchandise caps; grab bag of Rexona Men V8 product. The Promoter will organise and choose flights and accommodation; return airport transfers between Auckland airport and the hotel in Auckland and between Hotel and Hamilton 400 Street Circuit. The venues are provisional at the time of printing but will be provided to the winner prior to the trip upon notification that they are the winner.

9.Spending money, other meals, taxes, insurances, transport to and from the departure point, additional transfers and all other ancillary costs are the responsibility of the winner. Prize must be taken within the dates set by the Promoter to coincide with the Hamilton 400 Street Race and is subject to booking and flight availability. The Promoter accepts no responsibility for any loss incurred if the event is cancelled for any reason beyond the control of the Promoter.

10.The Major Prizes will be drawn 24th March 2009 and will be contacted by telephone within 168 hours (seven days) to obtain name and address details. No responsibility is accepted for lost or misdirected entries. The Promoter will attempt to telephone the winning entry a minimum of once and a maximum of five times over a 168 hour period. Any telephone calls will only be made between 8am and 7pm daily. If the Promoter and / or its agencies are unable to speak with the winner in person within 168 hours of drawing the winning entry, a new winner may be drawn and the original winner will forfeit their prize at the discretion of the Promoter.

11.Prize values are correct at the time of printing however the Promoter accepts no responsibility for any variation in the prize values.

12.The Promoter is not responsible for any incorrect or inaccurate information caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, internet, mobile or satellite network failure.

13.In the event that for any reason whatsoever the Major Prize winners do not take an element of the Major Prize at the time stipulated by the Promoter, then that element of the Major Prize will be forfeited by the prize winner and cash will not be awarded in lieu of that element of the prize.

14.If the winner of the Major Prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.

15.Entrant / winners’ personal information (“PI") will be collected to enable the Promoter to administer this Promotion. Entrants / winners may contact the Promoter at the postal address given below to request access to or update any of their collected PI that is still held. If an entrant / winner does not truthfully provide all requested PI, the Promoter may determine that they are not eligible to receive a prize. If entrants indicate their consent at the point of entry, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.

16.A request to access, update or correct any information should be directed to the Promoter at their address set out below.

17.The total prize pool is $70,000.

18.The prizes are not transferable or exchangeable and cannot be taken as cash. To the extent permitted by law, the Promoter, its employees and agents shall not be liable for any claims, losses, damages, injuries, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential) as a result of, or arising out of, or in any way connected with this promotion. Except for any liability that cannot be excluded by law, the Promoter, its employees and agents exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer/prize values to those stated in these Terms and Conditions; (e) any tax liability incurred by a winner; or (g) acceptance or use of a prize.

19.If, for any reason, any part of this offer is not capable of running as planned, including war, terrorism, state of emergency or disaster, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of any part of this offer, the Promoter reserves the right (A) in its sole discretion to disqualify any individual who tampers with the claim/entry process, or may benefit from such tampering, and (B) to cancel, terminate, modify or suspend any or all of parts of the offer. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process. The Promoter’s decision is final and no correspondence will be entered into.

20.It is a condition of entry that the winner (and companions) may be required to execute a Deed of Acknowledgement, Release and Indemnity in a form prescribed by the Promoter in its discretion.
